This Course offers a practical approach to understanding procurement law in the planning and execution of tenders and competitions.
Procurement procedure can in the “right hands” be formulaic and cumbersome! At times it can almost a hindrance rather than a help. Both buyers and sellers have been known to dispair when an otherwise commendable tender falls foul to a technicality.
Of course, procurement procedure is subject to the rule of law and due process must be observed. If conditions are set for a tender then they must be applied. However is there a middle ground? Is there a line that respects the full rigour of procurement regulation, but appreciates the commercial objectives of the tender.
